What You Can Recover in a Tampa Car Accident Case? Overview

What you can recover in a car accident lawsuit in Florida depends on a variety of factors, including who is at fault, the extent of the property damage and physical injuries suffered and insurance policies involved.

However, there are general types of damages that can and usually should be pursued in every case. The following is a review of those damages. If you would like to learn more and receive a free consultation about your case, contact Disparti Law Group, P.A., today by phone or online.

General Damages in Florida Car Accident Cases

While every case will be different, in general, the compensation (legally known as “damages”) sought in a personal injury lawsuit resulting from a car accident include:

  • Property damage – This includes the cost to repair or replace your motor vehicle and may include the cost to rent a vehicle while your car is being repaired. This may also include the costs of other property damage that occurred in the car accident, such as to a boat or trailer being towed. You may seek these damages from the at-fault driver. However, in some cases, you may turn to your own auto insurance policy if you purchased collision coverage.
  • Medical expenses – This includes funds to reimburse you for all of your treatment costs, from the ambulance ride through hospitalization and recovery. Your recovery should include all doctors’ exams, tests, medications, surgery, anesthesia, rehabilitation therapy and assistive devices and payment for all anticipated future medical expenses.
  • Lost income – This includes actual wages and other income (the value of benefits, anticipated bonuses, commissions) that have been lost during your recovery. It can also include projected losses from lost earning capacity and/or lost opportunities for career advancement.
  • Pain and suffering – In cases with  a more serious injury such as the loss of a limb or some other permanent injury, scarring or disfigurement, then a lengthy recovery or disability would be cause for more pain and suffering damages than a broken arm or leg, for example.

A wrongful death lawsuit would also seek compensation for:

  • Funeral and burial expenses
  • Lost support and services
  • Loss of companionship.

If the car accident was caused by especially egregious misconduct, then punitive damages may also be sought to punish the at-fault driver.
