In Chicago, a patient’s guardian successfully sued the hospital where the patient’s twins were delivered because she was left disabled following the delivery. The patient carrying the twins had what is known as a “placenta accreta.” This is when the placenta is attached deeply to the uterine wall. After her doctor successfully delivered her twins, the doctor delivered the placenta. There is evidence that during this process, the placenta was torn and caused the patient to hemorrhage, leaving her with seizures and a hypoxic brain injury. While the patient was unable to bring a lawsuit forward, her guardian brought it forward on her behalf and stated that the hospital–Presence Hospitals–was negligent in its care of the patient.
The medical malpractice suit claims that in addition to improper care by the anesthesiologist, the patient did not receive the necessary resuscitative care and there was no blood in the operating room available for a transfusion, leaving the patient waiting more than half an hour for a necessary transfusion. Because of the damage the hospital did, the patient now has an intellectual age of 3 years and 3 months old. The jury in this medical malpractice case awarded the plaintiff $14,756, 744.03. This included damages for:
- Past medical expenses
- Future medical expenses
- Future caretaking expenses
- Loss of normal life
- Pain and suffering
