(CHICAGO) August 20, 2024 — Today, we celebrate Disparti Law Group attorney Amanda Martin and her team for closing an $800,000 settlement for five motorcyclists tragically hit by a dump truck on their way home to Illinois from Tennessee. The successful outcome of this case shows that even when tragedy strikes away from home, nothing stands in our way when standing up for the lives and well-being of our fellow Illinois citizens.
Motorcycle Riders Struck by Dump Truck
On June 27th, 2022, five motorcycle riders were headed back home to Illinois from a vacation down south. While they were all stopped at a red light at an intersection in Tennessee, they were struck from behind by a dump truck that failed to observe the red light.
Several of the riders were taken to the hospital with severe to life-threatening injuries. Disparti Law Group, with the support of local counsel in Tennessee, sued the dump truck owner and the driver.
Negotiating with Insurance Companies
A motorcycle accident lawsuit usually involves negotiations with insurance companies. These companies are notorious for low-balling settlement offers in an attempt to pay as little as possible to the injured party. At Disparti Law Group, we never let these tactics stand.
This particular case presented a unique conflict in that there were other injured parties in the accident besides the five motorcyclists we represented. Martin and her team fought for what they knew their client deserved and procured 80% of the insurance policy at mediation.
Beware of Statute of Limitations in Other States
Another unique factor in this case is that the motorcycle riders were Illinois residents but the accident occurred in Tennessee. This presented its own challenges to the case as personal injury laws can differ from state to state. For example, the statute of limitations in Tennessee for a personal injury lawsuit is only one year whereas in Illinois it is two years.
The summer and fall is a great time to do that bucket list cross-country road trip. But it’s important to be aware of the laws in each state you’ll be crossing into in case of an accident. A good rule of thumb is to contact a lawyer as soon as possible following a motorcycle or motor vehicle accident to avoid any issues with the statute of limitations.
Additionally, the sooner your attorney can start collecting evidence and building your case, the better. If too much time passes, vital evidence may be lost and important details of the accident forgotten.
Contacting a Lawyer Following a Motorcycle Accident
If you were recently injured in a motorcycle accident, reach out to legal counsel as soon as possible. The financial aftermath of an accident can be overwhelming as expenses such as medical bills, vehicle repairs, and potentially lost wages can start to add up.
An experienced motorcycle accident lawyer can help preserve critical evidence, such as witness statements and accident scene photographs, and ensure all necessary paperwork is filed promptly. They can also help protect you from potential pitfalls, such as inadvertently admitting fault or accepting an inadequate settlement offer from insurance companies.
This major win shows how Disparti Law Group always aims to reach the maximum settlement for our clients. It’s what they deserve, and we always fight to win.
