Today, Attorneys Jonel Metaj and Larry Disparti of Disparti Law Group parted downtown Chicago to head down to Springfield to fight for the rights of victims of uninsured motorist and hit-and-run accidents.
On September 24,2020, Cristopher Guiracocha was riding his bicycle and was hit by a motorist who never stopped to check on his well-being and safety. With medical bills mounting up, Cristopher’s family reached out to his father’s car insurance plan which is supposed to cover situations like this.
Direct Auto, his father’s insurer, denied the claim stating that Cristopher would have had to occupy the insured car in order for him to be covered under their uninsured motorist policy.
The case, Direct Auto vs. Fredy and Cristopher Guiracocha, went to the Circuit Court and it was ruled that the insurer’s policy would stand and coverage would be denied. However, Metaj and the team at Disparti Law would not accept that and chose to appeal.
The Appellate Court reversed the ruling of the Circuit Court, stating that the provision in the Direct Auto policy denying coverage to insureds who are not occupying the insured vehicle, violates Illinois public policy and is not enforceable.
Direct Auto appealed the decision to the Illinois Supreme Court.
On September 21, 2023, Attorney Jonel Metaj, accompanied by Larry Disparti, will argue in front of the Illinois Supreme Court on behalf of their clients – and all victims of accidents by uninsured or hit-and-run accidents. The Supreme Court of Illinois will be hearing arguments at 9:00 a.m.
