Do You Need a Social Security Benefits Attorney?
Most people focus on their jobs and don’t consider how they’ll make ends meet if a disability leaves them unable to work. The chances of being disabled are higher than you might think. More than one out of four of today’s 20-year-olds will become disabled before retirement, according to the Council on Disability Awareness. If you become permanently disabled or unable to work for an extended period, disability benefits are available. They include Social Security disability, Disabled Widow or Widower benefits, Disabled Adult Child benefits, Disabled Veterans benefits and Supplemental Security Income.

Understanding the Types of Social Security Disability Benefits
It’s important to understand the different types of benefits that are available. That will give you an idea of your options for obtaining monthly cash benefits if you develop a disease, long-term disability or permanent mental or physical disability that prevents you from working. Florida ranks among the top five states in the number of disability determinations, according to the Florida Department of Health. The benefit programs include:
- Social Security Disability Insurance Benefits — The benefit is financed by taxes paid by workers and employers. An individual must have earned sufficient work credits through taxable work to qualify, and the amount of the benefit is based on lifetime average earnings. Disability benefits are paid to disabled workers, their widow or widower, their children and adults who have been disabled since childhood.
- Disabled Widow and Widower’s Benefits — A disabled spouse who is unable to work may qualify for disability benefits if between the ages of 50-59 and the disability occurred within seven years of the death of the spouse and the disabled widow or widower has not remarried. The monthly benefit is based on an average of the deceased spouse’s earnings. The average disabled widow benefit was $683 in 2008, according to the Social Security Administration.
- Adult Disabled Since Childhood Benefits — An unmarried adult, disabled before the age of 22, may become eligible for a disabled child’s benefits if a parent starts receiving Social Security retirement or Social Security disability benefits or if the parent dies. The payments are based on the parent’s record of earnings.
- Children of Disabled Workers — A child or stepchild or dependent grandchild of a disabled individual may be eligible for Social Security disability benefits if they are under the age of 18 and unmarried, or up to age 19 if a full-time high school student. Within a family, each qualifying child may receive a monthly payment of up to half the disabled individual’s payment.
- Supplemental Security Income Benefits — The Supplemental Security Income program makes cash payments to disabled individuals who have limited incomes and qualify. According to the Social Security Administration, approximately 8,039 disabled individuals in Florida received Supplement Security Income benefits. Florida residents who qualify for an SSI check automatically qualify for Medicaid as well.
- Veterans Benefits — Veterans may receive tax-free disability compensation for injuries or diseases acquired while on active duty. You also may be eligible for disability benefits if an existing disease or injury was made worse by your military service. Generally speaking, there are two types of compensation for disabled veterans: disability compensation and non-service connected disability pensions.
